Eagle One Terms of Use

These terms are an agreement between you and Charlie Bieger (“we”, “us”), the independent developer of Eagle One. By downloading or using Eagle One you agree to them. If you do not agree, do not use the app.

Eagle One is an independent, unofficial app. It is not affiliated with, endorsed by, sponsored by or acting on behalf of Boston College, TransLoc, any dining or transit operator, or Apple.

Who may use Eagle One

You must be at least 13 years old. If you are under the age of majority where you live, you may use Eagle One only with the involvement of a parent or guardian who agrees to these terms. Eagle One is provided for personal, non-commercial use.

Your account

Eagle One requires Sign in with Apple. Your Apple Account is managed by Apple under Apple’s terms, not ours. You are responsible for keeping access to your device and Apple Account secure, and for activity that occurs through your Eagle One account. You may delete your Eagle One account at any time in Settings › Delete Account; what that removes is described in the Privacy Policy.

Feedback you send

If you submit feedback or a support request, you grant us permission to store it, read it and use it to answer you and to improve the app. Do not send confidential information, and do not send personal information about anyone else. You can have your submissions deleted by deleting your account or by emailing us.

Third-party information

Dining menus and hours come from publicly accessible Boston College Dining feeds. Shuttle routes, vehicle positions, arrival estimates and alerts come from publicly accessible TransLoc services. Eagle One displays this information for convenience, does not control it, and claims no ownership of the underlying data, names or marks, which belong to their respective owners. Estimates and accuracy

Arrival estimates in Eagle One are predictions. They combine the operator’s published schedule and estimates, live vehicle positions, travel times, and patterns Eagle One has observed on your device. Predictions are frequently wrong, and information can be delayed, incomplete or unavailable. Do not rely on Eagle One for emergencies, for safety-critical decisions, or where being wrong could cause harm, missed transport, missed deadlines or other loss.

Availability and changes

Eagle One is provided free of charge on an as-available basis. Features, availability and these terms may change, and access may be suspended or discontinued at any time. Continued use after a change means you accept the updated terms; the date above shows when they last changed.

Disclaimer of warranties

To the fullest extent permitted by law, Eagle One is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including any warranty of accuracy, availability, uninterrupted or error-free operation, merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, missed buses, missed meals, missed deadlines, scheduling problems, or any other loss arising from or relating to your use of the app, your reliance on information it shows, service interruptions, or problems with third-party data.

To the fullest extent permitted by law, our total liability for all claims relating to the app will not exceed the greater of the amount you paid for the app in the twelve months before the claim (which for Eagle One is zero) or ten US dollars. Some jurisdictions do not allow the limitation of liability for certain damages, so parts of this section may not apply to you. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Indemnity

You agree to indemnify and hold us harmless from claims and costs arising out of your misuse of the app or your breach of these terms, except to the extent caused by us.

Intellectual property

Eagle One’s name, design, artwork and software are ours or our licensors’. These terms grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. If you believe content in the app infringes your rights, email us with details and we will respond promptly.

Apple

These terms are between you and us only, not with Apple. Apple is not responsible for Eagle One or its content. Apple has no obligation to provide any maintenance or support for Eagle One. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory compliance, or consumer protection claims, or any intellectual property infringement claim. You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not on any US Government prohibited or restricted party list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Termination

You may stop using Eagle One at any time and delete your account in Settings. We may suspend or end access if you breach these terms or if we discontinue the app. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnity and governing law — will survive.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules, and you and we submit to the exclusive jurisdiction of the state and federal courts located in Massachusetts. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there.

General

If any provision of these terms is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us about Eagle One. You may not assign these terms; we may assign them in connection with a transfer of the app.

Data sources and attribution

Dining hall menus, hours and nutrition come from publicly accessible Boston College Dining feeds. Shuttle routes, stops, vehicle positions, arrival estimates and alerts come from publicly accessible TransLoc services. Eagle One displays and re-estimates this information for convenience, does not control it, and claims no ownership of the underlying data, names or marks.

Maps, walking directions and travel-time estimates are provided by Apple MapKit. Map data is © Apple Inc. and its data providers.

Allergen and dietary filters are based on the labels published in the Boston College Dining feed. They are a convenience, not a medical safeguard. Labels can be incomplete, delayed or wrong, and cross-contamination is not represented. If you have a food allergy or intolerance, confirm with dining staff before eating.

Boston College and TransLoc names, logos and marks belong to their respective owners.
